01 Acceptance of these terms
These terms apply to delivery drivers who use the Masil Driver app, whether they apply through the app or receive an account from a restaurant they deliver for. Masil altiqniyah Establishment operates the app and the platform behind it.
By applying, logging in or using the app you agree to these terms and to the Masil Driver Privacy Policy. If you do not agree, do not use the app.
02 Your relationship with the restaurant
In short: the restaurant you deliver for engages you, assigns your orders and pays you. We provide the app they use to do that. We are not your employer and we are not a party to your arrangement with the restaurant.
- The restaurant: reviews your application, decides whether to accept you, assigns deliveries, sets what you are paid and how, and may end your access at any time.
- The platform: runs the app and keeps the records of your deliveries. Any question about pay, schedules or your work should go to the restaurant.
03 Eligibility and applying
- You must be at least 18 years old and legally allowed to work as a delivery driver in Saudi Arabia.
- You must hold a valid driving licence and the registration and insurance your vehicle requires, and keep them valid while you deliver.
- Everything you enter in the application must be true and about you. The restaurant may decline an application or close an account that is based on false information.
- You may withdraw an application at any time before the restaurant decides on it.
04 Your account
- Your account is personal. Do not share your username or password, and do not let anyone else deliver under your account.
- You are responsible for everything done through your account. Tell the restaurant at once if you think someone else has used it.
- One person, one account. Do not create more than one account or an account for someone else.
05 Using the app and making deliveries
- Go on shift only when you are actually available, and accept only the orders you can deliver.
- Deliver orders promptly, safely and in the condition you received them.
- Follow traffic laws at all times. Never operate the app while driving; stop safely first.
- Treat customers and restaurant staff with respect.
- Customer details shown in the app — name, phone number and address — are for that delivery only. Do not store, copy or share them, and do not contact a customer after the delivery is complete.
- Do not interfere with the app: no fake or altered locations, automated access, reverse engineering or attempts to reach other restaurants' data.
06 Location
While you are on shift the app sends your location to the platform so the restaurant can assign nearby orders and, during an active delivery, so the customer can follow the driver on the order tracking screen. It does not use background location and collects nothing while it is closed.
You can withdraw the location permission in your phone's settings at any time; the app will then be unable to show nearby orders or share your position. What is collected and how long it is kept is described in the Masil Driver Privacy Policy.
07 Cash and payment
- Cash you collect on cash orders belongs to the restaurant. Hand it over in full, as and when the restaurant requires. The app records what you collected but does not hold any money.
- Your pay for deliveries is set and paid by the restaurant under your arrangement with it. The platform does not pay drivers and does not take a share of what you earn.
- Fines, fuel, maintenance, insurance and other costs of your vehicle are your own unless the restaurant agrees otherwise.
08 Suspension and ending your access
The restaurant may remove you from its drivers at any time. We may suspend or close an account that is used in breach of these terms, for fraud, or in a way that puts customers, restaurants or the platform at risk.
You can delete your account from inside the app at any time: open More, then Delete account. Records of completed deliveries and the cash collected stay with the restaurant for the period Saudi law requires, as described in the Privacy Policy.
09 Disclaimer and liability
The app is provided "as is". Maps, routes and estimated times come from third-party services and may be wrong; you remain responsible for how you drive. We are not liable for outages caused by third-party services, networks or your device.
We are not liable for traffic incidents, fines, damage to your vehicle, or for disputes between you and the restaurant or a customer. You are responsible for insuring yourself and your vehicle.
10 Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed, and we will announce significant changes in the app. Continuing to use the app after a change means you accept the new terms.
11 Governing Law
These terms are governed by the laws of the Kingdom of Saudi Arabia. Exclusive jurisdiction lies with the courts in Saudi Arabia.
